Terms and Condition

These Terms govern your access to and use of KartTell (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Definitions

• “We/Us” means [Company/legal entity name] operating KartTell.

• “Merchant/You” means the person or entity using the Service to run a store.

• “Customers” are your end buyers.

2. Account & Eligibility

You must be at least 18 and able to form a contract. Keep your login secure and notify us of any unauthorised use. We may refuse, suspend, or terminate accounts that violate these Terms.

3. Subscriptions, Billing & Taxes

• Plans renew automatically unless cancelled before the renewal date.

• Fees are shown exclusive of taxes. You are responsible for applicable taxes (e.g., SST) related to your subscription and sales.

• Except where required by law, fees are non-refundable. Service remains active until the end of the paid term after cancellation.

• We may change prices with prior notice for the next term.

  
  

4. Payments & Payouts (Your Store)

KartTell integrates with third-party payment providers (e.g., FPX/Stripe/PayPal). Provider terms apply. We do not hold, receive, or settle your funds; all payouts and chargebacks are managed by the selected provider.

5. Your Responsibilities

You are solely responsible for:

• Products, pricing, promotions, stock, shipping, pickup and delivery

• Accuracy of listings, taxes (e.g., SST/VAT/GST where applicable) and issuing receipts/invoices

• Customer service, refunds/returns, and compliance with laws (consumer protection, e-commerce, PDPA 2010, etc.)

• Ensuring your use of WhatsApp complies with Meta policies and local regulations

Prohibited content includes illegal items, IP-infringing goods, unsafe or restricted products, hateful or adult content, and spam.

6. Content & IP

You retain ownership of your content. You grant us a limited, worldwide licence to host, display and transmit your store content solely to operate the Service.
All KartTell software, templates, and branding are our intellectual property.

7. Domains

You may connect a custom domain. You are responsible for DNS, renewal, and records. If you use a KartTell subdomain, we may reclaim or rename it for operational reasons.

8. Third-Party Services

Integrations (payments, analytics, messaging, shipping, etc.) are provided by third parties. Your use of those services is subject to their terms and privacy policies.

9. Data Protection

We process personal data in accordance with our Privacy Policy and Malaysia’s PDPA 2010. A Data Processing Addendum (DPA) is available on request for business accounts.

10. Support & Availability

We provide documentation, live chat/tickets during support hours, and reasonable efforts to keep the Service available. Planned maintenance or incidents may cause temporary interruptions.

11. Disclaimers

The Service is provided “as is”. We do not warrant uninterrupted or error-free operation, nor guarantee specific sales outcomes.

12. Limitation of Liability

To the maximum extent permitted by law, KartTell and its affiliates shall not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data or goodwill. Our aggregate liability for any claim is limited to the fees paid by you to us in the 12 months preceding the event.

13. Termination

You may cancel at any time from your dashboard. We may suspend or terminate if you breach these Terms, harm the Service, or act unlawfully. Upon termination, your right to use the Service ceases.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Malaysia / your jurisdiction]. Disputes will be resolved by [courts in Kuala Lumpur / chosen venue].

15. Changes to Terms

We may update these Terms. Continued use after changes take effect constitutes acceptance.
